Which Car Caused the Accident?

BACKGROUND: Our client insured the driver of a full-size Dodge Ram pickup truck that was involved in an accident with a Chrysler Concorde, resulting in the fatality of a passenger in the Concorde. Initial reports indicated that the Dodge Ram pickup truck struck the side of the Chrysler Concorde.

The driver of the Chrysler Concorde
Weather, road or vehicle malfunctions that were beyond the control of either driver

JUST THE FACTS:
Our accident reconstruction investigation included topographical scene documentation, inspecting vehicles and reviewing the police report and accident investigation. This information revealed that the Chrysler Concorde was traveling eastbound on a road, which had a stop sign at the intersection where the accident occurred. The full-size Dodge Ram pickup truck was traveling north on a crossroad that did not have a stop sign at this same intersection. When the Chrysler Concorde pulled away from the stop sign the Dodge Ram pickup truck struck the passenger side of the Concorde, fatally injuring the passenger in this vehicle.

Calculations from measurements at the scene showed that the Dodge Ram pickup truck was traveling below the posted speed limit at the time of the accident. While there was no indication of pre-impact skid from this vehicle, there was evidence that the vehicle tried an evasive maneuver to the right in an attempt to avoid the accident. However, pre-impact speeds and acceleration rates from the stop sign suggest that the Chrysler Concorde did not come to a complete stop before entering the intersection. Furthermore, inspection of the vehicles and interviews from police reports failed to indicate any evidence of any mechanical malfunction in either vehicle.

FINDINGS:
Our conclusion was that the Chrysler Concorde violated the right-of-way of the full-size Dodge Ram pickup truck, causing the accident.
